Now this case in New York, this one I'm staying on the sidelines about because I haven't followed it at all, I have no clue the details behind it all. Ferguson, you had no choice but to follow it from day one because it's all the news ever talked about half the time, but this, I haven't really followed, so I'll just have to sit back and watch the discussion on this one.
The guy who filmed this was charged. With what I'm not sure but he was charged I do know

While I will NEVER advocate looting and burning when there's injustice or perceived injustice, you really have to be a black person to really understand just how the cards are stacked against us. Yes, the American Dream is obtainable by anyone who works hard enough and yada yada and yes, black people are their own worst enemy most of the time, but "the system" really does fuck black people over consistently
Yeah, the chokehold wasn't necessary, but in the heat of the moment, the officer probably thought it his best angle to try and get the guy under control, as tall and large as that guy was. I'm over 6' and a large guy myself, but even I would have needed some kind of leverage to get that guy on the ground and handcuff him if he was resisting, I wouldn't have been able to get him under control through straight up maneuvers and strength. That's about the only justification I see for the officer going for a chokehold during the arrest, just based off of knowledge gleaned SOLELY from that video.Quote:

Guy saying he can't breathe disregards that banned chokehold as well because he's big.

however, Garner was apparently under arrest for the illegal selling of cigarettes (some sort of NY tax law from what i gather). he clearly refuses to go peacefully under arrest so Pantaleo takes him down with some sort of move. Garner appears to be HUGE (much larger than any of the officers scene in the video) so a take down move would be appropriate under the circumstances (resisting arrest).
thus, the only issue is whether the officer used a "banned" "choke hold" or some other type of maneuver. if the move used was indeed previously "banned" "choke hold" then the officer should most likely have been charged with involuntary manslaughter (negligent homicide for the use of a banned procedure). however, if he used a move authorized by the police department then its likely just a "bizzarre" death caused by the apparent poor health of Garner.
Bottom Line: DO NOT RESIST ARREST FROM A POLICE OFFICER EVEN IF THE CHARGES ARE "BOGUS"
What was he being arrested for?
In the past it was for untaxed cigarettes. This had nothing to do with that other than harassment it looks like. There was no purpose for an arrest it appears other than I guess you are suppose to shut up and bend over even if you aren't in the wrong

I am not in crowd of all "white" people are bad, or all cops are bad (personally I believe most are nice people), hell back in the day a cop pulled up on us while we were in high school, and some friends were smoking weed, all he did was take the weed and told us to go home. No handcuffs, no harassing, simply took our ID's checked us out and off we went and he was even white. I truly do understand that there are some rough neighborhoods out there, but where is the line between being a good cop and just being flat out wrong? Its a hard position to be in and an even harder question to answer.
There has to be a line drawn that says all people of color are not guilty until proven innocent no matter what there socioeconomic status is.....
But hey what do I know about anything.........I am just a 31 year old dad with no life outside of work and kids <----probably the truest statement I have made int his entire post. :D
FYI.....I think the issue is really more of a policing and profiling issue than a race one....in case you really wanna know.
In regards to Eric Garner, this has no bearing in the case. The cops knew who they were dealing with as he had been arrested 31 times since 16. This was nothing new for Garner and he should have simply let the cops do their job and live to see his family another day. Instead he did not want to be arrested, things got out of hand and we end up with an unfortunate death for selling untaxed cigarettes. The cop who used a choke-hold which was not a sanctioned use of force was in the wrong. That said when you have a such a large man resisting arrest and his flight or flight is flowing, you tend to not be running down the rulebook in your mind in an attempt to get the criminal to comply. I say that again, he was a criminal and refused to comply. Number one way to prevent cops from trying to arrest you is to not break the law. Something really simple that applies to both cases.Quote:

About 7 years ago wife and I were having sex...TMI I know.
Apartment complex we lived in (small one...6 units in the building), all 1 bedroom. Our neighbor who told us before in the 10 words total she ever said to us in 2 years...didn't agree with interracial couples. She was older and wasn't the first time she tried to make a complaint about us.
Apparently she called police and said a child was being abused that day. We didn't have a child until 4 years ago...our first. Actually no one in the complex had any kids. 4 cops show up, 1 female and rush into our apartment. They corner me while the other 2 look for this phantom child being abused. My wife is pissed and asking smart ass questions "like is it illegal to have sex", "This is bull shit", basically apparently stuff you shouldn't say to cops according to opinions here. I'm trying to calm her down even though we are kept apart. Now my wife is 5-2..not threatening at all but if that would have been me I'd been arrested after "bull shit". Female cop then tells my wife well apparently you sound like a child when having sex. Wife grew more irate.
She also said some other things and they demanded our ID's and stayed a good bit to make sure that a child didn't show up at our house a little later. Questioned what we did for a living and some other stuff.
We weren't having outrageous sex or anything and you couldn't have heard it unless you had an ear to the wall. This same neighbor called police for a noise complaint on us that we were playing loud music...although we were actually sleep and no music was on.
She may have forgotten that there was a guy a floor above who was a DJ....common mistake though.
