This is what the scene looks like. He's in the center towards the fence side, according to the police scanners.

SOMEONE in the FBI is losing a job though. according to reports Big Brother was questioned by the feds in 2010 after a foreign government tipped the U.S. government that he was a radical terrorist and they gave him the green and allowed him to travel to russia (where he likely got training as a terrorist). :smh:

Come on Obama's reach out to the Muslim world CLEARLY is working wonders. Never mind the fact that Bush's post 9/11 philosophy lead to 0 attacks and Obama's has lead to 2.

EDIT: Interesting Obama is ignoring his rhetoric of the past by not requiring his FBI to Mirandize this SOB immediately. Listen to what I say not what I do. Over/Under on number of articles/blogs from the left calling Obama out for this = ZERO.

If you are intellectually incapable of understanding how policy re: Islam and whether or not terrorists are Enemy Combatants or just regular Criminals you should consider reading up. One addresses prevention of this type of event and another addresses gathering intelligence to try to prevent future attacks and of lesser importance (apparently) in this case the admissibility of evidence at trial. However, if a Court rules the government violated #2's Miranda rights anything they learned from that questioning could NEVER be used in a court (including if he gave up 50 more co-conspirators they would basically get off scott free thanks to the doctrine of Fruit of the poisonous tree)

Yet the 9/11 attack happened under his watch and his policies. You cant blame Clinton if you are basing it on attacks on US soil while under a Presidents watch.

Bush
WTC - 2,606 deaths

Obama
Ft Hood - 13
Boston - 3

So 26 or 2606? Playing your little game Obama is the clear winner. I may not like many of his policies but it is this blinders on zealotry, on both sides of the isle, that is going to ruin this great nation we live in.

If you mean Benghazi, CLW made reference to two attacks so I limited them to the ones on *US soil. I was only using CLW's comment to show him the folly of his ways. When a terrorist strikes there are no winners.

* Not all of our embassies are considered to be on US Soil, that varies by Nation.

I was just going to post those links, SC. Not surprising at all; I think most probably expected that to be the case. It is disconcerting that the Russians had a pretty good idea of what the older brother was up to, but we were unable to find anything. (I would think his trip overseas last year should have raised red flags. :dunno: I've read articles saying he was never on radar, another saying when he returned from trip that he was. So much bad/conflicting information throughout this whole thing.)

Depending on what you read, he either died from a suicide vest, from the shootout, or from his brother running over him to get away. :dunno:

I'm sure it will change in the next few hours, but supposedly he has a throat injury and may not talk again. Perhaps from shooting himself through the mouth (failed suicide attempt). We probably won't learn anything from him, unfortunately.

Dershowitz: Feds will regret not Mirandizing bomber:

http://www.realclearpolitics.com/video/2013/04/22/dershowitz_authorities_will_regret_not_reading_bos ton_bomber_miranda_rights.html (http://www.realclearpolitics.com/video/2013/04/22/dershowitz_authorities_will_regret_not_reading_bos ton_bomber_miranda_rights.html)

If you buy the initial Obama/liberal logic Dershowitz is right. Obama et al. have stepped in a big pile of you know what and this case could not go very poorly IF the law is applied appropriately. Of course, it seldom is and will likely be ignored for this case.

I don't get it. Did I miss something? Was Obama there making the capture? I'm sure he didn't tell the cops/Feds "Don't give this dude Miranda rights." I'm sure that in all the excitement, they probably just forgot (considering the dude was bleeding and whatnot) and whatever ruling they're provoking is to put a band-aid on an oversight. I understand you're not an Obama fan but I can't see how this is Obama's fault. That's a stretch.

The owner of the now famous boat interviews with the local Boston news. What a nice guy.

This part wasn't in the video, but so many people are wanting to buy him a new boat and he says "NOOOO, there are people who have lost lives and limbs, send it to the Boston One fund. I have a canoe!"

You should read articles discussing the differences between crimes and acts of war and how it affects acts of terrorism and make up your own mind.

Suffice it to say, I do NOT agree with the premise that these people are merely criminals as Obama (and the left does). Rather, I subscribe to the premise that radical Islamists/Jihadsts are at war with the U.S. and thus their actions should be treated as such.

This, I agree with. I'm aware that extremist out there who want to take us out from the inside using fear and whatnot and those people should be dealt with accordingly.

What I disagree with is that the arresting cop didn't read the guy his Miranda right and that's somehow Obama's fault.

Well I either poorly posted or you didn't understand the post. My point was NOT that Obama screwed up b/c he didn't have the cops Mirandize douche bag. My point was I STRONGLY disagree with Obama's initial premise that douche bag is a criminal and not at war with the U.S.

IF you agree with my premise that Boston was an act of war (and not a crime) then you agree with me that douche bag should never be Mirandized b/c he has no such rights.

On the other hand, if you agree with Obama's premise that Boston was just a "mere" crime. Then he has to be and the cops likely screwed up (although courts will likely make bad law here to cover up for the cops mistake).

Interestingly (to me at least) a STRONG argument can be made that the entire concept of Miranda (Supreme Court case) is flawed and thus no one has any Miranda "rights" under the Constitution. However, that is an entirely different discussion and requires far too much posting/reading for anyone here (other than me) to probably care to get into.

Alright, that makes more sense but it raises another question.

Is it ok to treat it like a crime initially until all the facts are in THEN switch to war/terror crimes or do we just go war/terror crimes from the jump until we find out more information? I assume that treating things like a war/terror crime gives authorities more leeway in apprehending and interrogation than regular crimes, correct?

Which comes first egg/chicken? For me you treat any "major attack" like this as an act of war 1st and we have a military system of justice where the Judge there could rule it was not an act of war and kick it to the criminal justice system when/if necessary.

IF you treat it as a crime 1st they would be entitled to U.S. Constitutional rights (such as "Miranda rights"). It's hard to undo something like that once you open "Pandora's box".

Only one issue. The younger brother is an American citizen, and was arrested in the US. So he couldn't be tried in a military tribunal as an enemy combatant. He would have always ended up in the civilian courts from the beginning. They just invoked the public safety thing to hold him and question him without mirandizing him first.

Well ignoring the Constitutional issue re: whether a state(s) have the right to leave the union. Americans have engaged in war against the Federal Government before see the Civil War.

There are also several KNOWN acts that a person immediately loses his/her U.S. citizenship 8 U.S.C. 1481 including: "taking an oath or making an affirmation or other formal declaration of allegiance to a foreign state or a political subdivision thereof, after having attained the age of eighteen years" and "committing any act of treason against, or attempting by force to overthrow, or bearing arms against, the United States, violating or conspiring to violate any of the provisions of section 2383 (http://www.law.cornell.edu/uscode/text/18/2383) of title 18 (http://www.law.cornell.edu/uscode/text/18), or willfully performing any act in violation of section 2385 (http://www.law.cornell.edu/uscode/text/18/2385) of title 18 (http://www.law.cornell.edu/uscode/text/18), or violating section 2384 (http://www.law.cornell.edu/uscode/text/18/2384) of title 18 (http://www.law.cornell.edu/uscode/text/18) by engaging in a conspiracy to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, if and when he is convicted thereof by a court martial or by a court of competent jurisdiction."

IMHO. Mr. Douche bag lost his U.S. citizenship the moment he and his douche bag of a brother pledged allegiance to the Islamic terrorists and began plotting their attack. As such the U.S. Constitution no longer applies and he committed an act of war and should be treated as such w/o his former citizenship in the U.S. being taking into consideration.

Well, unless I'm reading that incorrectly, it's saying he loses it after he has been convicted by a court martial or court of competent jurisdiction. You may believe and consider him to have lost it at that moment, but I'm not sure I'd believe that until a court says otherwise. Until then, who the hell knows how this turns out without him having been mirandized.

That's a fair point (if you consider land line versus cell phones the same) and contrary to MANY conservatives I find a NUMBER of faults with Reagan and his presidency. I disagree with giving people free land lines and I disagree with giving people free cell phones.

I was merely referring to the phone as most of its recipients now refer to it as.
